Welcome to WHALE NFT Pro. Our platform offers rare NFTs. Before proceeding, please:

• - Read our introduction carefully before activating your profile.
• - Double-check all information before purchasing any NFT to avoid errors or misunderstandings.
• - Never purchase under pressure; all purchases must be voluntary and made with sound judgment.
• - Manage your finances responsibly and purchase only within your budget. Do not borrow funds to buy NFTs.
• - Do not use your entire savings to buy NFTs.
• - Remember: blockchain transactions are final and cannot be undone.

1. Definitions

1. “NFT” means a non-fungible token.
2. “Platform” means the WHALE NFT Pro website that provides a marketplace for purchasing NFTs.
3. “User” means any individual who accesses or uses the Platform.
4. “Buyer” means a User who purchases an NFT on the Platform.

2. Use of the Platform

1. - Your use of the Platform is subject to these Terms, the Privacy Policy, and any other policies or guidelines posted on the Platform.
2. - By using the Platform, you represent and warrant that you have the legal capacity to enter into this Agreement and comply with its terms.
3. - You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.
4. - You are solely responsible for any transactions you perform on the Platform.

3. NFT Transactions

1. - NFTs listed on the Platform are sold directly through the Platform to Buyers. The Platform is not a contracting party to any transaction and bears no liability arising from such transactions.
2. - The Platform does not guarantee the accuracy, legality, or quality of any listed NFT. Buyers must conduct their own due diligence before purchasing.
3. - The Company provides no warranties or representations regarding any listed NFT, including, without limitation, ownership, title, authenticity, or fitness for a particular purpose.
4. - Sellers are solely responsible for ensuring they have the legal right to sell any NFT listed on the Platform.
5. - Buyers are solely responsible for ensuring they have the legal right to purchase any NFT listed on the Platform.
6. - Buyers cannot sell any NFT back to the Platform, its owners, promoters, developers, or team members.

4. Disclaimer of Warranties

1. - The Platform and all services are provided “as is” and “as available”, without any warranties of any kind, whether express or implied.
2. - The Company makes no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any content or materials on the Platform.
3. - The Platform does not endorse, verify, or guarantee any NFTs sold on the Platform.

5. Limitation of Liability

1. - To the maximum extent permitted by law, the Owners, Promoters, Developers, any Team Members, any Upline Members, and any individuals working with the Company shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use or inability to use the Platform, any NFT transactions, or any content or materials on the Platform.
2. - You acknowledge that neither the Platform nor any associated individuals shall be responsible for any purchases, investments, or losses incurred by you or other Users. You participate in NFT transactions at your own risk and discretion.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Owners, Promoters, Developers, Team Members, Upline Members, the Platform, and the Company’s affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Platform, your breach of this Agreement, or your violation of any applicable laws or regulations.

7. Irreversibility of Blockchain Transactions

All on-chain actions, including purchases, transfers, and approvals, are final and irreversible. The Company cannot modify, cancel, or refund blockchain transactions.

8. Changes to the Terms

The Company may update these Terms from time to time. Continued access to or use of the Platform after updates constitutes your acceptance of the revised Terms.

9. Severability

If any provision of this Agreement is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Agreement, together with any policies referenced herein, constitutes the entire agreement between you and the Company regarding your use of the Platform.
